ORDINANCE 10-145
AN ORDINANCE TO AMEND CERTAIN PROVISIONS OF SECTION 14-402.3 OF THE MUNICIPAL CODE, COMPUTATIONS, TO CORRECT CONFLICTING LANGUAGE REGARDING THE SIGN AREA CALCULATION METHOD; PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Lakeland Sign Ordinance regulates certain signs based on area; and,
WHEREAS, the Sign Ordinance provides a method by which area is calculated for various types of signs; and,
WHEREAS, the Sign Ordinance was amended in 2004 to provide a new sign calculation method, but a conflict was created between the text and a related exhibit.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND TENNESSEE THAT:
Section 1. The City of Lakeland Sign Ordinance, Section 14-402.3 is hereby amended, as more fully described and illustrated in Exhibit “A” attached hereto.
Section 2. The provisions of this Ordinance are severable. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid provision or application.
Section 3. This Ordinance shall take effect immediately after its final passage and publication, the public welfare requiring it.

Public Hearing: February 23, 2010
Final Reading: March 04, 2010.

14-402.3. Computations.
(1) Area Computation of Individual Signs: The area of a sign face (which is also the sign area of a wall sign or other sign with only one face) shall be calculated by enclosing the extreme limits of all lettering, background, emblem, logo, representation, or other display as depicted in Figure 1 within a single continuous perimeter composed of squares or rectangles with no more than eight lines drawn at right angles, but not including any supporting framework, base, bracing or decorative fence or wall when such fence or wall otherwise meets the regulations of this Ordinance and is clearly incidental to the display itself. For a single wall on a single-occupant building, all pieces of information or other graphic representations on that wall shall be measured as though part of one sign, which may not exceed the maximum permitted sign area. For a single wall on a multi-occupant building, the area of signs shall be computed based on individual occupant signage, using these principles, but only the number of signs on the approved sign plan shall be permitted on each wall.
