AN ORDINANCE AMENDING ORDINANCE 09-130 PERTAINING TO RESIDENTIAL AND COMMERCIAL SEWER USER RATES
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAKELAND, TENNESSEE:
Section 1: Ordinance 09-130 is hereby amended as follows:
Section 2. The existing Lakeland Residential and Commercial sewer user rates are amended as follows:
CITY OF LAKELAND SEWER USER RATES
Residential UPON PASSAGE OF THIS ORDINANCE AND FOR CALENDAR YEAR 2011, the Sewer Rate shall be $0.717 $0.90 per CCF after 8.02 CCF plus $12.00 minimum charge THE $12.00 MINIMUM BASE RATE CHARGE SHALL BE APPLIED TO THE FIRST 8.02 CCF. THE MAXIMUM MONTHLY SEWER USE CHARGE IS $30.00 THERE IS A $10.00 MONTHLY SEWER SURCHARGE ADDED TO ALL CHARGES
(CCF =100 CUBIC FEET=748 GALLONS)
FOR CALENDAR YEAR 2012 , THE SEWER RATE SHALL BE $1.12 PER CCF AFTER 8.02 CCF PLUS A $12.00 MINIMUM CHARGE. THE $12.00 MINIMUM BASE RATE CHARGE SHALL BE APPLIED TO THE FIRST 8.02 CCF. THE MAXIMUM MONTHLY SEWER USE CHARGE IS $30.0. THERE IS A $10.00 MONTHLY SEWER SURCHAGE ADDED TO ALL CHARGES.
Commercial UPON PASSAGE OF THIS ORDINANCE AND FOR CALENDAR YEAR 2011, THE SEWER RATES SHALL BE $1.10 $1.00 PER CCF, $45.00 MINIMUM UP TO $1000.00 MAXIMUM PLUS $10.00 MONTHLY SURCHARGE
FOR CALENDAR YEAR 2012, THE SEWER RATE SHALL BE $1.21 PER CCF, $45 MINIMUM UP TO $1000.00 MAXIMUM PLUS A $10.00 MONTHLY SURCHARGE

ORDINANCE 10-146
AN ORDINANCE RESCINDING ORDINANCE 09-140 AND CREATING A NEW ORDINANCE ESTABLISHING A STORM WATER BOARD OF APPEALS FOR THE CITY OF
LAKELAND TO REVIEW CIVIL PENALTIES AND/OR DAMAGE ASSESSMENTS
CONCERNING STORM WATER MANAGEMENT AND POLLUTION CONTROL PLANS
WHEREAS, the City of Lakeland wishes to provide aggrieved parties an avenue for administrative appeal due to civil penalties and/or damage assessments from the requirements of Ordinance 04-67 (Title 18 Chapter 6) Pertaining to Storm Water Management and Pollution Control Plans;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND THAT:
Section 1. CREATION
There is hereby created a Storm Water Board of Appeals to review civil penalties and/or damage assessments concerning storm water management and pollution control plans.
Section 2. MEMBERSHIP, TERM and PROCEDURE
The Board shall be composed of five (5) citizen members of Lakeland with experience and knowledge in storm water management and pollution control plans and appointed by a majority vote of the Board of Commissioners. The term of all citizen members shall be three years. The term of at least one (1) citizen member of the board shall expire each year. Procedures of the Storm Water Board of Appeals shall be provided for in the By-Laws.
Section 3. JURISDICTION
The Storm Water Board of Appeals shall have jurisdiction to review civil penalties and/or damage assessment concerning storm water management and water pollution plans
Section 4. DUTIES
It shall be the duty of the Storm Water Board of Appeals to hear and decide any appeal or any decision, order or interpretation by the officer whose duty it is to enforce the ordinance from which an aggrieved party seeks relief, provided the matter is within the jurisdiction of the Storm Water Board of Appeals.
Section 5. VARIANCES
The Storm Water Board of Appeals shall have authority to grant variances from those ordinances of the City of Lakeland over which it has jurisdiction and only to the extent provided in the ordinance from which appeal is before the Storm Water Board of Appeals.
Section 6. SEVERABILITY
The provisions of this Ordinance are severable. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions or application of this Ordinance that can be given effect without the invalid provision or application.
Section 7. EFFECTIVE DATE
This Ordinance shall take effect fifteen (15) days after its final passage and publication, the public welfare requiring it.

AN ORDINANCE TO AMEND CERTAIN PROVISIONS OF SECTION 14-402.3 OF THE MUNICIPAL CODE, COMPUTATIONS, TO CORRECT CONFLICTING LANGUAGE REGARDING THE SIGN AREA CALCULATION METHOD; PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Lakeland Sign Ordinance regulates certain signs based on area; and,
WHEREAS, the Sign Ordinance provides a method by which area is calculated for various types of signs; and,
WHEREAS, the Sign Ordinance was amended in 2004 to provide a new sign calculation method, but a conflict was created between the text and a related exhibit.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND TENNESSEE THAT:
Section 1. The City of Lakeland Sign Ordinance, Section 14-402.3 is hereby amended, as more fully described and illustrated in Exhibit “A” attached hereto.
Section 2. The provisions of this Ordinance are severable. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid provision or application.
Section 3. This Ordinance shall take effect immediately after its final passage and publication, the public welfare requiring it.

14-402.3. Computations.
(1) Area Computation of Individual Signs: The area of a sign face (which is also the sign area of a wall sign or other sign with only one face) shall be calculated by enclosing the extreme limits of all lettering, background, emblem, logo, representation, or other display as depicted in Figure 1 within a single continuous perimeter composed of squares or rectangles with no more than eight lines drawn at right angles, but not including any supporting framework, base, bracing or decorative fence or wall when such fence or wall otherwise meets the regulations of this Ordinance and is clearly incidental to the display itself. For a single wall on a single-occupant building, all pieces of information or other graphic representations on that wall shall be measured as though part of one sign, which may not exceed the maximum permitted sign area. For a single wall on a multi-occupant building, the area of signs shall be computed based on individual occupant signage, using these principles, but only the number of signs on the approved sign plan shall be permitted on each wall.
