ORDINANCE 11-157
AN ORDINANCE AMENDING ORDINANCE 09-139 PERTAINING SANITATION FEES

WHEREAS, Tennessee Code Annotated, § 68-211-901 et seq. provides that municipalities have authority by ordinance to adopt rules and regulations deemed necessary to accomplish the purpose of this statute, including the adoption of a system of fees for sanitation collection services.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAKELAND, TENNESSEE.

Section 1: Ordinance 09-139 is hereby amended and the following new Section is added.

Section 2. Establishment of new monthly Sanitation Rate commencing on March 4, 2011 as follows:

Solid Waste Residential Fee: $22.39/customer/month

Section 3. Yard Waste Collection collected outside of the Yard Waste Cart shall be charged by the City’s Refuse Collection and Disposal Contractor at the rate of $25.00 for the first thirty minutes and $10 per five minutes thereafter.

Section 4. In the event of major adverse weather events that produce an abundant amount of yard waste debris in the community, the Board of Commissioners grants the City Manager authority to waive yard waste collection fees for a period not to exceed three weeks for each event.

Section 5. The cost for an additional yard waste cart is $3.30 per customer per month.

BE IT FURTHER ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND THAT:

This Ordinance shall take effect immediately after its passage on second and final reading, the public welfare requiring it.

First Reading: February 3, 2011.
Public Hearing: February 22, 2011.
Final Reading: March 3, 2011.
