ORDINANCE 06-84
AN ORDINANCE ABANDONING PUBLIC RIGHT-OF-WAY ON ROADWAYS REFERRED TO AS CHAMBERS COVE ROAD, OLD SEED TICK ROAD AND OLD CANANDA ROAD


WHEREAS; the City of Lakeland is committed to maintaining public roadways to high standards within its jurisdiction where such roadways serve the public use and benefit the public generally; and
WHEREAS; the City of Lakeland is currently a no-tax City that strives to offer its citizens quality services commensurate with said no-tax status; and
WHEREAS; the Board of Commissioners of City of Lakeland has determined that Chambers Cove Road has not been accessible to the general public for approximately (10) years; and
WHEREAS; there are currently no citizens of the City of Lakeland residing on Chambers Cove Road, Old Seed Tick Road or Old Canada Road, and no citizen of Lakeland has resided on Chambers Cove Road, Old Seed Tick Road or Old Canada Road for a considerable period of time; and
WHEREAS; the Board of Commissioners of the City of Lakeland has determined that Chambers Cove Road, Old Seed Tick Road exceeding fifteen (15) years; and Old Canada Road provide no benefit to the public generally as they are dead-end roads traversing currently undeveloped property; and
WHEREAS; the Board of Commissioners of the City of Lakeland has determined that Chambers Cove Road, Old Seed Tick Road and Old Canada Road provide no long-term strategic transportation benefit to the City of Lakeland as reflected on the City Transportation Plan.
WHEREAS; access to Chambers Cove Road was limited to curtail illegal dumping of trash, transactions involving contraband substances and other such public nuisances, all of which have been determined by the Board of Commissioners of the City of Lakeland to be detrimental to the public safety and welfare of the citizens of the City of Lakeland; and


WHEREAS; the Board of Commissioners of the City of Lakeland has determined that Chambers Cove Road provides no benefit to the public generally as it is a dead-end road traversing currently undeveloped property; and
WHEREAS; the condition of Chambers Cove Road has deteriorated to the point that considerable sums of money would need to be expended by the City of Lakeland to bring it up to current city roadway standards for public passages.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND THAT:
1. The roadway referred to as Chambers Cove Road, running generally from Chambers Chapel Road to the U.S. I-40 right-of-way and further described and depicted on Exhibit A attached hereto and incorporated by reference as if fully set forth herein, be and hereby is abandoned and vacated as a public thoroughfare and right-of-way with the City of Lakeland retaining no further right of any kind or purpose for public access and/or maintenance.

2. The roadway referred to as Old Seed Tick Road, running generally from Canada Road to Beverle Rivera Boulevard and further described and depicted on Exhibit B attached hereto and incorporated by reference as if fully set forth herein, be and hereby is abandoned and vacated as a public thoroughfare and right-of-way with the City of Lakeland retaining no further right of any kind or purpose for public access and/or maintenance.

3. The roadway referred to as Old Canada Road, running generally from parcels L0159 00389 and L0159 00031 to U.S. I-40 right-of-way and further described and depicted on Exhibit C attached hereto and incorporated by reference as if fully set forth herein, be and hereby is abandoned and vacated as a public thoroughfare and right-of-way with the City of Lakeland retaining no further right of any kind or purpose for public access and/or maintenance.

4. This Ordinance shall take effect immediately upon final passage and publication, the public welfare requiring it.

First Reading: January 05, 2006.
Public Hearing: January 23, 2006.
Final Reading: February 02, 2006.
