ORDINANCE 07-102
AN ORDINANCE TO AMEND TITLE 14, CHAPTER 11 (ARCHITECTURAL DESIGN STANDARDS); PROVIDING AN EFFECTIVE DATE


Whereas, the Municipal Planning Commission evaluated amendments to City of Lakeland Design Guidelines Title 14, Chapters 9, 10, and 11 (Landscaping and Screening Requirements, Site Lighting Requirements, and Architectural Design Standards), respectively to permit waivers for mixed use or traditional neighborhood design Planned Developments, at meetings on September 14, 2006 and November 20, 2006, and

Whereas, copies of the amendments in question are on file at City Hall, and were provided on a CD-Rom to the Municipal Planning Commission on August 21, 2006, and

Whereas, legal notice was published, and the Municipal Planning Commission recommended approval of the proposed amendments on November 20, 2006.

Now therefore be it ordained by the board of commissioners of the city of Lakeland, Tennessee that:

Section 1. Title 14 of the Lakeland Municipal Code Chapters 11, is hereby amended, as more fully described and illustrated in Exhibit “A” attached hereto.
Section 2. The provisions of this Ordinance are severable. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid provision or application.
Section 3. This Ordinance shall take effect fifteen (15) days after its final passage and publication, the public welfare requiring it.


First Reading: December 05, 2006.
Public Hearing: January 04, 2007.
Final Reading: February 01, 2007.
