ORDINANCE 06-92
An Ordinance to Amend Title 13, Chapter 1, Section 13-104 of the Lakeland City Code; and Providing an Effective Date


WHEREAS, the City of Lakeland adopted Lakeland City Code, Title 13, Chapter 1, Section 13-104 which limits the height of grass and other vegetation in the City of Lakeland; and

WHEREAS, the City of Lakeland has researched this ordinance and this amendment is based on those findings; and

WHEREAS, the City of Lakeland continuously seeks opportunities to improve the provision of governmental services and must therefore amend ordinances associated with providing such services; and

WHEREAS, a Public Hearing before the Board of Commissioners of the City of Lakeland was held pursuant to a notice thereof published in a newspaper of general circulation within the community; and

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND, TENNESSEE THE FOLLOWING:

Section 1. Lakeland City Code, Title 13, Chapter 1, Section 13-104 is hereby amended, as follows:

13-104. Weeds. Every owner or tenant of property shall periodically cut the grass and noxious weeds on his or her property. It shall be unlawful for any person to fail to comply with an order by the City of Lakeland or his or her designee to cut such vegetation when it has reached a height of one foot if located in an undeveloped area, or a height of one-half foot if located within a developed area, except for those parcels containing five acres or more land area. A developed area shall refer to a platted subdivision or lot of record. Areas intended to be left in a natural state such as, Conservation Easement and natural areas, shall be exempt from these provisions.

BE IT FURTHER ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF LAKELAND THAT:

This Ordinance shall take effect immediately upon its passage on second and final reading, the public welfare requiring it.

First Reading: June 1, 2006.
Public Hearing: June 26, 2006.
Final Reading: July 6, 2006.
